Why motorcycle claims are valued higher

Motorcyclists are vulnerable road users: in a collision there is no metal cage, crumple zone or airbag between the rider and the road. The same impact that leaves a car driver shaken can throw a rider into the carriageway, so the injuries that follow tend to be more severe — limb fractures, road rash and degloving injuries to exposed skin, and head injuries even when a helmet is worn. Compensation tracks the injury, not the vehicle, so these more serious injuries produce larger general-damages awards than a typical car claim for the same crash.

General damages — the injury itself

General damages compensate you for the pain, suffering and loss of amenity caused by the crash. In England and Wales these are valued from the Judicial College Guidelines (JCG), the standard reference for every body part and severity. For riders, the brackets that matter most are usually fractures, knee and leg injuries, head injury and scarring from road rash. Whiplash lasting up to two years is the exception — it is paid under a fixed statutory tariff. In the US there is no national table, so typical published settlement ranges are used.

Special damages — your financial losses

On top of the injury value you can recover the money you actually lost: lost earnings while you could not work, medical treatment, physiotherapy and rehabilitation, care and travel. Riders can also claim the cost of the damaged motorcycle, helmet, leathers and other protective gear, plus recovery and storage charges. Because rider injuries are often serious, future losses — ongoing care, further surgery or reduced earning capacity — frequently form a large part of the total.

Helmets, gear and contributory negligence. You can still claim where the crash was the other party's fault, but your award may be reduced for contributory negligence if the lack of a helmet or proper protective gear made your injuries worse. Courts in England & Wales have applied reductions where a missing or unfastened helmet contributed to a head injury. Wearing approved gear protects both your safety and the full value of your claim. The whiplash tariff (£275–£4,830 for accidents on or after 31 May 2025) still applies to a rider's minor neck injury.

Who pays a motorcycle accident claim?

In most cases the compensation is paid by the at-fault driver's motor insurer. Many motorbike claims involve a car or van driver who failed to see the rider — the classic "sorry mate, I didn't see you" collision — and liability turns on that failure to look properly. If the driver who hurt you was uninsured or untraced, UK claims can be made through the Motor Insurers' Bureau (MIB); many US states provide uninsured/underinsured motorist cover that does the same job.
