Two ways a cyclist gets hurt — and who you claim against
Cycling accident claims usually fall into one of two categories, and the difference decides who pays. The first is a collision with a motor vehicle — a driver who pulls out, opens a car door into your path, or fails to give way. The second is a crash caused by the state of the road itself: a pothole, sunken drain cover or other defect. Either way the injury is valued the same — general damages plus special damages — but the defendant changes.
Collisions with drivers
Where a driver is at fault, the claim is paid by their motor insurer, just like any road traffic accident. Cyclists are vulnerable road users, and the Highway Code places particular responsibility on drivers around them. If the driver was uninsured or untraced, UK claims can be made through the Motor Insurers' Bureau (MIB); many US states provide uninsured/underinsured motorist cover.
Pothole and road-defect claims
In England and Wales the highway authority has a duty under section 41 of the Highways Act 1980 to maintain the highway. If a pothole or defect caused your crash, you may be able to claim against the council. The authority has a statutory defence under section 58 if it can show a reasonable system of inspection and repair, so photographs, measurements and the exact location of the defect are vital evidence. In the US, claims against a government body for a road defect are possible but follow strict, state-specific notice rules and short deadlines.

What a cyclist can claim for
Alongside general damages for the injury, you can claim special damages for your financial losses: lost earnings while you could not work, medical treatment and physiotherapy, care and travel. In England & Wales a moderate wrist injury is valued from the Judicial College Guidelines at roughly £12,800–£29,400, and a serious head injury can reach six figures, plus special damages such as lost earnings, treatment and the cost of your bike and kit. In the US a cyclist injury settlement commonly runs from $10,000 for a soft-tissue injury into the hundreds of thousands for catastrophic injury, depending on the state and policy limits.
Can I claim if a pothole caused my crash (highway authority)?
Often yes. Does not wearing a helmet reduce my claim?
Cycle helmets are not compulsory for adults in the UK, and not wearing one does not bar a claim. Injuries unrelated to the head are unaffected by helmet use.

In England & Wales the general limit is three years from the accident, or from when you first knew the injury was accident-related, with different rules for children and people who lack capacity. Claims against a highway authority for a pothole still fall within the three-year limit.
