What counts as nursing home abuse or neglect

Nursing-home claims cover both deliberate abuse and neglect — a failure to provide the standard of care a resident is entitled to. Federal law gives nursing-home residents specific rights, and a breach that causes harm can found a claim.

Residents have legal rights

Residents of Medicare- or Medicaid-certified facilities are protected by the federal Nursing Home Reform Act and CMS regulations, which guarantee a standard of care and freedom from abuse and neglect. Suspected abuse can also be reported to your state's Long-Term Care Ombudsman and Adult Protective Services.
