How nerve damage claims are valued

Nerve injuries are not valued as a single category — the figure depends on which nerve is damaged and the loss of function, sensation or power that results. Damage to a major nerve such as the brachial plexus (the network supplying the arm), the sciatic nerve, or a nerve controlling the hand can be far more serious than a localised sensory nerve injury. In England and Wales the figure comes from the relevant section of the Judicial College Guidelines (JCG), often valued together with the limb affected. Minor nerve injuries

Localised nerve injuries causing numbness, tingling or altered sensation that largely recovers sit at the lower end — indicatively £3,000–£13,000. The figure depends on how long the symptoms last and whether any weakness remains.

Moderate nerve damage

Nerve damage causing lasting weakness, persistent altered sensation, neuropathic pain or some loss of function — for example damage to the ulnar nerve at the elbow, or partial nerve injury affecting grip or foot movement — is typically valued at £13,000–£40,000.

Severe nerve injuries

Serious nerve injuries causing significant permanent disability — such as a serious brachial plexus injury affecting use of the whole arm, or nerve damage causing foot drop, loss of bladder or bowel control, or severe neuropathic pain — fall at the top, from roughly £40,000 to £140,000. What affects a nerve damage payout

  • Which nerve and how much function is lost — the main driver; major motor nerves are valued highest.
  • Neuropathic pain — lasting burning or shooting nerve pain raises the award and can develop into a chronic pain claim.
