Who you can claim against
- The driver of your own car, if their negligence caused the crash.
- The other driver, if they were at fault.
- Both drivers, where fault is shared between them — you still recover in full from the combined cover.
- Uninsured/underinsured motorist cover, if the at-fault driver had no or too little insurance.
Claiming against a friend or family member who was driving can feel awkward, but in practice the claim is paid by their insurer, not them personally — which is exactly what the insurance exists for.

Frequently asked questions
How much compensation can I get as an injured passenger?
It depends on your injuries and losses, not your role — you are almost never at fault as a passenger. A minor soft-tissue claim may settle around $5,000–$25,000, while fractures, head injuries or permanent harm reach far higher. The calculator gives a realistic range from what you enter.
Can I claim if a friend or family member was driving?
Yes. If the driver of the car you were in was at fault, you claim against their auto insurance — the payout comes from the insurer, not the person. This is exactly what liability insurance is for, and it does not normally affect your personal relationship.
What if both drivers were at fault?
As a blameless passenger you can claim against both at-fault drivers and recover your full compensation from their combined insurance. You do not have to choose between them or prove which was more to blame — that is sorted out between the insurers.
Does not wearing a seat belt reduce my claim?
It can. If a seat belt would have prevented or reduced your injuries, a court may apply a comparative-negligence reduction for that portion. Otherwise, passenger claims are usually clean on liability. The calculator does not apply any such reduction.
How long do I have to claim as a passenger?
Each US state sets its own statute of limitations, commonly two to three years from the crash. The same deadline applies whether you were a driver or passenger, so act early and keep your medical and loss records.
